Terms of use
Placeholder terms — review by a qualified South African attorney is recommended before launch.
1. Nature of the service
This website provides an independent, automated analysis of procurement deviation and expansion reports published by the National Treasury of South Africa. It is an information and commentary service operated in the public interest. It is not affiliated with, endorsed by, or authorised by the National Treasury, the Office of the Chief Procurement Officer, or any government department, entity or supplier.
2. Opinion, not findings of fact
The flags, priority scores and commentary on this site are expressions of opinion based on facts disclosed on the site — namely the reason recorded in the official register and general, verifiable statements about the relevant market. They are offered as fair comment on a matter of public interest. Nothing on this site is, or should be read as, an allegation or statement of fact that any person or organisation has acted unlawfully, irregularly, dishonestly, fraudulently or corruptly. A flagged entry may be entirely lawful and properly justified by documents not contained in the public register.
3. Accuracy and source data
Underlying data is extracted automatically from third-party PDF reports and may contain errors of extraction, classification or value. The site is provided on an “as is” and “as available” basis. No warranty is given that the information is complete, current or error-free. Always consult the original source document, which is linked from each entry, before relying on any information.
4. No professional advice
Nothing here constitutes legal, financial, procurement or other professional advice, and it must not be relied upon for any decision. You should obtain your own professional advice.
5. Limitation of liability
To the maximum extent permitted by law, the operators of this site exclude all liability for any loss or damage (including direct, indirect, incidental, special, consequential or punitive loss, loss of profit, reputation, or opportunity) arising from or connected with the use of, or reliance on, this site or its content, whether in contract, delict, statute or otherwise, even if advised of the possibility of such loss. Where liability cannot lawfully be excluded, it is limited to the fullest extent permitted by law.
6. Right of reply
Any party named in the register may submit a response or correction request via contact@tender-deviations.org. See the right-of-reply process.
7. Intellectual property
The underlying procurement data is the property of the National Treasury and is republished from public reports. The analysis, code and presentation are the property of the site operators.
8. Governing law
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
9. Changes
These terms may be updated from time to time. Continued use constitutes acceptance of the current terms.
